All cash based activity on the site is currently suspended pending review by the Gaming Supervision Commission of an application for a licence to operate as a gambling Web site under the laws and regulations of the Isle of Man. References to cash based acitivities here are for information only since cash predicting is not available or possible at this time.

Foretal is a Web site containing Predictions about future events, some are published by Foretal itself, but most are published by registered Foretal members.

Predictions can be either a 'Free Prediction', or a 'Free and Cash Prediction'.

Foretal Members vote either Yes or No on these Predictions to reflect whether they believe it will turn out to be Correct or Incorrect by a given date.
-
This date is known as the Proposed Outcome date, and is decided by the Predictor when the Prediction is submitted to Foretal.
-
With 'Free Predictions', no money is required to publish or vote on the Prediction, and no money can be won from getting the Prediction right.
-
'Free Predictions' may have a Proposed Outcome Date at any time in the future.
-
'Free and Cash Predictions' can be voted on for free and for cash, and cash can be won from getting the Prediction right.
-
'Free and Cash Predictions' may only have a Proposed Outcome Date within two years of publication.
-
Predictors of Free and Cash Predictions get a commission of 3% of the overall number of cash votes won by members on their Prediction, whether their Prediction is correct or not.

Foretal members who wish to take part in any cash based activity must be a bona fide account holder with Foretal's nominated transaction partner Neteller and abide by Neteller's terms and conditions of service.

Foretal members from the United States may not take part in any cash based activities on the site.
-
All registered Foretal members must abide by the laws of their own country and the country they are living in.
-
Member accounts will be suspended or cancelled by Foretal if it is informed that any relevant laws are being broken.

Anyone may include links to Foretal Predictions in their own Web sites or blogs.

NB: To submit a Prediction for publication, the member must first make a Prediction Proposal. This Proposal must be Accepted by Foretal before it can be published. Acceptance is usual but not automatic, and Foretal reserves the right to modify the Proposal before the member publishes it. Typically this is done to ensure that the Prediction is clear and unambiguous, but Foretal may Decline a Proposal if, for example, it feels that the Prediction might be illegal or likely to bring Foretal into disrepute.

Foretal membership is open to anyone over the age of 18 who completes the registration process and provides a valid e-mail address.

Participation in cash based activities requires members to comply with Foretal's transaction partner, Neteller.

Foretal members are obliged to comply with Foretal's Terms and Conditions, and Foretal reserves the right to suspend or cancel membership at any time, particularly if Foretal believes that a member is abusing Foretal's systems, or being anti-social towards other Foretal members.

Individual Members may have only one registered account on Foretal. A supplementary account that comes to the attention of Foretal will be closed and cash in this account's cash balance will be returned (less commission).

Foretal credits are generated by registered users voting on Free Predictions.
-
A single vote on a Free Prediction generates 1 Foretal credit.
-
Visitors to Foretal do not need to be registered or logged in to vote on free Predictions and therefore generate credits.

However, to save these credits, a visitor must log in during their Foretal session, or vote after logging in.
-
If a visitor leaves the site before either registering or logging in, their credits are discarded.
-
Each Foretal member can only vote once on each Free Prediction, and votes cannot be changed from one side to another.

When the Outcome to a Prediction is declared by Foretal, it is either Correct or Not Correct.
-
Credits can also be won by voting on the correct side of an Actual Prediction Outcome.
-
If Foretal declares the Prediction Correct, all the credits on the No side are distributed equally to those users who voted Yes.
-
If it is Not Correct, all the credits on the Yes side are distributed equally to users who voted No.
-
Credits distributed in this way can have a maximum of 2 decimal places when divided between winning voters.

Free Predictions cost no money and bring no cash dividend to either voter or predictor.

4 - Making a 'Free Prediction'

Any registered Foretal member whose account is in good standing can submit one or more Predictions for publication on Foretal.

To submit a Free Prediction to Foretal costs 10 credits.
-
When making a Free Prediction, the predictor must select three websites which will be used to substantiate whether the Prediction is correct or not.
-
Once submitted, the Prediction will only be visible to the predictor. No one will be able to view the Prediction and vote on it, until it has been accepted by Foretal.

A decision on acceptance will normally take place within 24 hours of the Prediction being submitted.
-
Foretal offers no guarantee that it will publish a Prediction.
-
In the event that a Prediction is not accepted, the Prediction tariff of 10 Foretal credits is not returned.
-
A Prediction may be rejected for publication on Foretal for any reason at Foretal's own discretion.

When submitting a Prediction, there is a limit in the number of characters for the wording of Prediction and its description. Predictions must be worded clearly and unambiguously. Foretal reserves the right to edit the text of a Prediction, but not the proposed outcome date, prior to its publication.

When submitted, a Prediction can be associated with one or more of the categories offered by Foretal.

5 - Making a 'Free and Cash Prediction'

To publish a 'Free and Cash Prediction', or upgrade a 'Free Prediction' to a 'Free and Cash Prediction', the Predictor must pay a deposit tariff of €5.

Free and Cash Predictions allow people to vote on the Prediction both for Free and for Cash. The voting scores for Free and Cash ballots are kept separate.

The predictor wins a commission of 3% of any losing cash votes that are distributed to winning cash voters.
-
Of the deposit, €1.00 is kept by Foretal, and the remaining €4.00 is split and applied as 2 cash votes to both the Yes and No ballots of the Prediction.

The balance of €4.00 is treated as normal cash votes made by the predictor and are distributed in the same way as any other votes when the outcome is declared.
-
As with Free Predictions, when a new Free and Cash Prediction is made, it must be accepted by Foretal before it is published.

The Proposed Outcome Date is a day by which the event or situation described in the Prediction must take place for it to be Correct.
-
The predictor chooses the Proposed Outcome date when making the Prediction. It cannot be changed.
-
The end of the Proposed Outcome Date is taken as 23:59:59 on that day according to Greenwich Mean Time.

When making a Prediction, the predictor must choose three Web sites which will record the event or situation described in the Prediction.
-
Two of the Web sites must be chosen from those pre-selected by Foretal, one can be inputted by the predictor.
-
These Web sites may not be altered by the predictor after they have been included in the published Prediction.
-
Foretal will only declare a Correct Outcome if at least two out of three of these substantiating sites unequivocally confirm the event or situation.
-
The confirmation must appear on these Web sites at any time between when the Prediction is published until 12.00.00 GMT on the day after the Proposed Outcome date.
-
Foretal's interpretation of the substantiating sites content is final.
-
Where the optional substantiating site is not well known to Foretal or does not appear to be a site of good standing, Foretal may ignore the content on that site at its own discretion when declaring an Outcome.
-
Foretal may change the list of these pre-selected sites for new Predictions at any time.

8 - The Actual Outcome Date and the Declaration of an Outcome

The Actual Outcome Date is the date when the Prediction is declared by Foretal to be either Correct or Incorrect.
-
The outcome must be reported on two out of three of the Substantiating Web Sites to Foretal's sole satisfaction.
-
The event must take place prior to midnight GMT on the Proposed Outcome Date, and the event must be recorded on at least two of the substantiating Web sites prior to midnight on the day after the Proposed Outcome Date.
-
If the outcome is substantiated by Foretal as Correct, then Foretal will declare for the Yes voters and they will win.
-
If the Prediction is declared Incorrect, then the No voters will win.
-
After the Proposed Outcome date has passed and the outcome has been declared it cannot be reversed.
-
When the Outcome Date is declared, Foretal will display the links on the substantiating sites that support the outcome, the time that the outcome took place, and brief reasons for the decision that was taken.
-
Registered Foretal members may inform Foretal of URLs that specifically record the outcome of a Prediction before it has been declared by clicking on the 'Tell Foretal' button within each 'Full View' of a Prediction.

Before an outcome is declared, the Prediction can be suspended at any time for any reason by Foretal, during which period no votes are accepted.
-
The outcome declaration may be reversed only if the substantiating Web sites retract their information and publish alternative information within 24 hours of midnight GMT at the end of the Proposed Outcome date.

9 - Adding and Redeeming Cash Votes.

Neteller is Foretal's sole cash transaction partner.
-
Foretal only permits the adding and redemption of cash to members accounts via Neteller.
-
No commission is levied on adding cash to Foretal.
-
A 6% commission is charged for redeeming/withdrawing cash from Foretal. This covers the cost of charges levied by Neteller.
-
A minimum of €10.00 can be added to or redeemed from Foretal in a single transaction.
-
Please note that before funds are redeemed to Neteller, a Foretal administrator will review the request for redemption before it is authorised. Typically this authorisation takes place within 24 hours, but in the event that a pattern of cash transfers appears suspicious and suggestive of Money Laundering, Foretal may confer with Neteller and other authorities who may instruct Foretal to suspend the redemption for an indefinite period while further investigations are undertaken.

Each cash vote costs €1.00.

Registered users can apply as many cash votes as they wish to either Yes or No ballots at any time.

Cash votes can be applied to both Yes and No ballots in a Prediction at the same time.

Cash votes may not be withdrawn once they have been placed.

Foretal may decide not to publish a Prediction, or remove a Prediction or a supplemental Prediction from the Web site at any time without notice and without explanation.

In that event, all credit balances for members who have participated in the Prediction remain untouched.
-
In the event that a Prediction is removed from the site by Foretal, all cash votes will be returned to those who have placed them normally within 24 hours of the removal of the Prediction.
-
Foretal is only obliged to return €4.00 of the predictor's €5.00 deposit tariff in these circumstances.

Supplemental Predictions are Predictions that are contingent on a prior Prediction.
-
In other words, if such and such a thing happens, then something else will happen.
-
Supplemental Predictions are considered to be 'children' of a 'parent' Prediction.
-
There is no limit to the number of supplemental Predictions that may be contingent on either side of a 'parent' Prediction.
-
Supplemental Predictions can also be appended to supplemental Predictions.
-
There is a limit of two levels of 'child' and 'grandchild' supplemental Predictions that can be appended to a 'parent' Prediction.
-
Anyone can add a supplemental Prediction to a Prediction or supplemental Predictions on the payment of a deposit with a tariff of €3.00.
-
Of this, €1.00 is retained by Foretal, and €2.00 is split equally between the Yes and No ballots.
-
A supplemental Prediction must have a proposed outcome date that is no earlier than its 'parent' Prediction.
-
A supplemental Prediction is contingent on one of either a Yes or No outcome of one 'parent' Prediction.
-
When the outcome of the 'parent' Prediction is declared, any supplemental Predictions that are contingent on the incorrect outcome are eliminated.
-
In this event, the free and cash votes of these Predictions, are held in a 'Floating Votes' ballot. These 'Floating Votes' are applied as a bonus to the Prediction with the highest number of cash voters at the point when the 'parent' Prediction's outcome is declared.
-
These 'Floating Votes' are shared according to the percentage of the winning amount each cash voter has in this Prediction.
-
When the outcome of a parent Prediction is declared Correct, any supplemental Predictions that are contingent on this remain and become 'parent' Predictions in their own right.
-
Any supplemental Predictions of these new 'parent' Predictions also remain.

13 - Distribution of Cash Votes and the Foretal Commission on Winnings.

When an Outcome is declared, the losing cash votes are distributed pro rata to the winners according to the percentage of the winning ballot that they own.
-
Thus if a winner has applied cash votes equivalent to 15% of the winning ballot they will be awarded 15% of the losing cash votes, less the Foretal commission.
-
This commission is 6% and is deducted from the losing cash votes.
-
This commission is distributed as follows: 3% is kept by Foretal, and 3% is returned to the predictor.
-
If the Actual Outcome date is declared earlier than the Proposed Outcome date, the Prediction is closed, once the Outcome is substantiated, and no additional votes can be placed.
-
Foretal will ignore votes that are cast after the predicted event or situation is reported to have taken place. The time from which this is calculated will be determined by Foretal at its sole discretion.

Cash votes that are ignored in these circumstances are returned to their voters within 24 hours of the declaration of the Actual Outcome date. (All free votes in these circumstances are discarded.)
-
IMPORTANT NOTE: Cash votes are only distributed after the proposed outcome date, even if the actual outcome date is much earlier.
-
Losing cash votes are distributed to winning voters within 24 hours from Midnight GMT on the proposed outcome date.
-
Foretal also takes a commission of 6% when transferring cash votes on eliminated supplemental Predictions to the 'Floating Votes' ballot.

14 - COMMENTS BOXES.
Please note the following terms and conditions which relate to the Comments boxes on www.foretal.com (the FORETAL web-site). The purpose of the Comments boxes is for you, the End-User, to discuss predictions and to allow full and inter-active use of the FORETAL website. The Comments boxes could therefore be described as mini-chat rooms, and as such are regulated by FORETAL (Isle of Man) Holdings Limited (we, us) in much the same way as chat rooms are moderated. These terms and conditions detail the basis for your permitted use of the Comments boxes: if you do not agree to these terms and conditions, you may not use the Comments boxes.
TERMS AND CONDITIONS
1. In using the Comments boxes you must comply with the following code of ethics:

You must not post any defamatory, threatening, obscene, harmful or pornographic material or material which would violate or infringe in any way upon the rights of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience or which do not comply with all relevant laws;
-
You must not express opinions that are vulgar, crude, sexist, racist or otherwise offensive, nor may you use offensive, indecent or abusive language;
-
You must always treat other users with respect. No harassment of other End-Users is allowed;
-
You shall not post or otherwise make available in the Comments boxes, any material which you do not own without the express permission of the owner of the material; and
-
You are solely responsible for your use of the Comments boxes. Accordingly, you agree to defend, indemnify, and hold us, our parents, subsidiaries, partners, (including anyone else involved in creating, producing or delivering FORETAL or the Software), affiliates, directors, officers, employees, and representatives harmless from and against any and all claims, demands, liabilities, losses, damages, costs and expenses, including legal fees, resulting from, arising out of, or in any way connected with your misuse of the Comments boxes.
2. In using the Comments boxes you acknowledge and accept as reasonable the following limitations of use:

We have full right to impose such controls on the use of the Comments boxes as we require;

Such controls are currently in place, and the use of the Comments boxes is moderated (including by the logging and recording of posts made to the Comments boxes);

You may not use the Comments boxes for any purpose of collusion (see clause 5.9 of the FORETAL terms and conditions for an explanation of this term), and we reserve the right to report any comments posted to such authority as we deem appropriate; and
-
We may remove the Comments box feature at any time.
